Welcome to Oz Capital! These Terms of Service ("Terms") explain the rules for using our website, https://www.ozcapital.io (the "Service" ). By using our Service, you agree to these Terms. Please read them carefully.
1. Our Services
Oz Capital is a platform that connects you with independent, third-party professionals who provide services related to residency and citizenship applications, as well as asset protection planning. We act as a consolidator and referral service; we do not provide legal, tax, or financial advice ourselves.
•Third-Party Professionals: All services are provided by independent lawyers, consultants, and other specialists. Your relationship with them is governed by a separate agreement you make directly with them.
•No Guarantees: We do not guarantee the success of any application or the outcome of any service. We are not responsible for the performance or quality of the services provided by third-party professionals.
2. Payments and Fees
•Service Fees: Our fees are for our advisory and referral services only and are quoted on a case-by-case basis. All fees are in United States Dollars (USD).
•Non-Refundable: All payments made to Oz Capital are final and non-refundable.
•USD Payments Only: Our service obligations are based solely on the USD amount you pay. This is completely separate from any digital tokens.
3. TOTOz and OZT Tokens
Our ecosystem includes two digital tokens, TOTOz and OZT, which have specific utilities.
•TOTOz (Utility Token): TOTOz is a utility token that gives holders priority access to limited-availability residency and citizenship programs. It is a credential for queuing and prioritization only. TOTOz is not a payment method, investment, or security.
•OZT (Governance Token): OZT is a governance token that allows holders to vote on proposals related to the Oz Capital ecosystem. OZT is not an equity instrument and does not represent ownership or a right to profits.
Token Distribution and Independence
•Pure Airdrop Model: TOTOz and OZT tokens are distributed through a free airdrop. We do not sell these tokens, and they do not represent an investment.
•Separation from Prior Programs: Our prior staking program ended on December 31, 2024. The current airdrop is a new policy implemented in response to evolving regulatory guidance and is completely independent of any past programs.
•Secondary Markets: Any trading of TOTOz or OZT on secondary markets is a third-party activity. We do not control these markets and make no representation as to the value of the tokens, which may be zero.
4. Your Responsibilities
•Accurate Information: You are responsible for providing accurate and complete information to us and to any third-party professionals.
•Independent Advice: You are responsible for seeking independent legal and tax advice in your own jurisdiction.
•Compliance: You agree to comply with all applicable laws and regulations.
•Indemnification: You agree to indemnify and hold harmless Oz Capital and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
5. Prohibited Users
Our Service is not available to citizens or residents of the Republic of the Philippines. By using our Service, you confirm that you are not a citizen or resident of the Philippines.
6. Intellectual Property
All content on our Service, including text, graphics, logos, and software, is the property of Oz Capital and is protected by intellectual property laws. You may not use our content without our permission.
7. Disclaimers and Limitation of Liability
•"As Is" Service: We provide our Service "as is" and without any warranties. We do not guarantee that our Service will be uninterrupted or error-free.
•Limitation of Liability: To the fullest extent permitted by law, Oz Capital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our Service.
9. Dispute Resolution
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in the British Virgin Islands.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after the new Terms become effective constitutes your acceptance of the changes.
